According to DNA, against the background of the pandemic caused by the COVID-19 virus, in the period from March 19, 2020 to September 16, 2021, Gabriel Tsutsu, as the general director of Romarm, allegedly entered into an association of companies of which he was a member, in violation of the provisions of the law. and a company controlled by Alexandru Pitzurke, under unfavorable conditions for the company he managed, concluded two public procurement contracts aimed at acquiring seven non-compliant machines for the production of protective masks.
“Thanks to the steps mentioned above, CN Romarm SA was damaged in the amount of 8,647,584 lei, representing the value of the mentioned machines, the value of raw materials, and later the value of some parts and related services (outside the contract),” according to the investigators.
In a similar context, the prosecutors claim that between March 19, 2020 and April 10, 2020, Gabriel Tsutsu demanded, among other things, from the representatives of the companies that participated in the above-mentioned purchases, the introduction into the commercial scheme of the supply of protective masks that do not meet the requirements of the Ministry of National Defense his friend, without him carrying out a real commercial activity additional to the contract for the supply of protection means, and making payments to him (40% of the profit share received) for the form of a consulting contract.
“In exchange for these ‘favors’, the suspect Gabriel Tsutsu would allow himself to be believed that he has influence over officials at MApN and that he will make them entrust directly and without public procedures the supply contracts, as well as perform without problems to obtain the relevant products and timely pay the invoices issued in connection with this. DNA also claims that Alexandru Pitsurka would have directly accepted the conditions put forward by Gabriel Tsutsu, in exchange for which the latter would allow it to be assumed that he had influence over some officials in MApN and that he would have induced them to entrust directly and without public procedures the contracts for delivery of means of protection against coronavirus.
