
Capital market taxation has changed. Investors will pay 1-3% depending on the holding period instead of 10%. In particular, the Law (142/2022) provides for a reduction of the income tax from transactions from 10% to 1% for securities held for more than one year, respectively 3% for securities held for less than one year. Taxation is carried out at source. The same taxation applies to those who invest through funds.

Last year, various people said that this law deprives investors of the Unified Declaration, which is partly false.
Decree 16/2022 (as amended by Law 370/2022) changed the ceilings. It is very easy for an investor to exceed the lowest payout limit, which is 6 minimum wages per economy, without having a very large investment (obviously it depends on the market, knowledge, guts). So you will have to submit a single declaration (it was needed even if the maximum amounts were not changed, and the only one left was 12 salaries).
We don’t know what the minimum salary will be in 2024 when the single income tax return for 2023 is due, but if we take the salary from 2023 (indicative) we will see that contributors above the first threshold will have to pay 1,800 lei after submission of the Unified Declaration.
Since they can no longer offset profit against loss, in some cases this is an additional charge.
As a tax, we are talking about 10% CASS (at each threshold: 6, 12, 24 salaries) plus 1-3%.
