On Wednesday, the Chamber of Deputies adopted Decree 119/2022 on limiting energy prices with several amendments proposed by the PSD-PNL-UDMR coalition. All opposition amendments were rejected. The bill regulates the energy market by 80%. Household consumers who exceed the threshold of 255 kWh per month will pay the difference at a price of 1.3 lei/kWh, just like large consumers.

With 177 votes in favor, 75 against and 11 abstentions, the bill approving GEO 119/2022 was passed by the Chamber of Deputies, which is also the decision-making forum for the matter.

According to the provisions adopted by the deputies, the final price of electricity suppliers in the bills is:

  • household consumers whose monthly consumption is from 0 to 100 kWh, inclusive, pay 0.68 lei/kWh
  • household consumers whose average monthly consumption is a maximum of 255 kWh pay 0.80 lei/kWh
  • household consumers whose average monthly consumption exceeds 255 kWh/month pay 1.3 lei/kWh

The following categories of household consumers use the marginal price of 0.68 lei/kWh:

  • those who use devices, equipment or medical equipment necessary for treatment, based on a request and a self-declaration; the final limited price in the invoices is applied from the first day of the month following the one in which the specified documents were submitted;
  • who support at least 3 children under the age of 18, respectively 26 years, if they study according to the form of education, based on the application and self-responsible declaration; the limited final invoice price is applied from the first day of the month following the one in which the specified documents were submitted.
  • single-parent families with at least one dependent child under the age of 18, corresponding to 26 years of education.

They will also benefit from a maximum amount of 1 lei/kWh, including VAT, for 85% of monthly consumption at the point of consumption, the difference in monthly electricity consumption is billed at a maximum price of 1.3 lei kWh. , with VAT on the basis of the declaration of personal responsibility of the legal representative for consumers:

  • small and medium-sized enterprises, as defined in Law No. 346/2004 on the stimulation of the creation and development of small and medium-sized enterprises, as amended and supplemented, hereinafter referred to as SMEs;
  • regional operators/operators that provide/provide public services, as well as the transport company of the Bucharest Metro “Metrorex” – SA;
  • economic entities in the field of food industry, identified by CAEN code 10, as well as in the field of agriculture and fishing, identified by CAEN codes 01 and 03;
  • local government bodies and institutions, decentralized public services of ministries and other central bodies, companies and commercial companies of district, municipal or local interest, autonomous governments and all public and private institutions providing public services, in accordance with the law, if they are established or organized at the level of communes, cities, municipalities, counties, Bucharest municipality
  • public and private hospitals determined in accordance with Law No. 95/2006 on health care reform, reissued with further changes and additions;
  • public and private educational institutions, as well as orphanages, state and private providers of social services provided by the Nomenclature of social services;
  • The limitation mentioned in this article also applies to situations where one of the previously mentioned business entities is the ultimate beneficiary of electricity consumption and/or to all buildings that have been constructed and authorized for hospital purposes.
