The recent changes to the Decree (EOG 119/2022) on capping and compensation of the energy price have forced suppliers to work harder.

Representatives of ACUE (Federation of Associations of Energy Companies) presented how the price is formed based on the new regulation.

“Up to 100 kWh/month, the price is 0.68 lei/kWh. Between 255 and 300 kWh, the first 255 are paid at 0.8 lei/kWh, and between 255 and 300 kWh, we set Art. 5 paragraph 1,” said Dana Daraban, ACUE’s executive director.

What is this point 5?

“This is a formula that calculates the average purchase price for a month, to which all other components are added. Somehow they calculate between 255 and 300 kW/h. With some ISPs, not all and not all ISP customers, you’re seeing some proactive messaging about the potential delays that may occur in this segment that has undergone changes and until the billing systems are in place,” she said.

According to ACUE, the former category 2 of the old GEO is violated (ie between 100 kWh and 300 kWh).

According to the cited source, up to 255 kWh, the consumer pays 0.8 lei/kWh, and if it exceeds 255 kWh, there are 2 payment options:

1. Or pay the contract price

2. Or pay the equation: the sum of the cost of supply, the cost of acquisition and other rates.

Why two options?

Because it is written in the law that the one that is beneficial to the client applies.

  • For example, if the contract price is lower than this amount, the difference over 255 kWh will be billed at this price.
  • If the sum of the purchase price, supply price and other regulated rates is lower than the customer’s current contract price, the excess of 255 kWh is billed at this resulting price.

“Over 300 kWh, nothing has changed,” says ACUE.

In the case of a consumer who had an average consumption of 100 last year and now consumes 255 kWh, he pays in the first category, 0.68 lei/kWh, they say.

Conversely, if a customer had an average consumption last year between 100-300 kWh, and now in the month for which we bill, his consumption is 280 kWh, he will pay 255 kWh for 0.8 lei, and he pays the difference between 255 and 280 kWh either at the contract price or at the sum of the purchase price and the supply price in accordance with Article 5.
