Elon Musk has formally asked Twitter’s former head of security, who recently accused the platform of lying, to provide documents and testify in a legal case against the social network, AFP reports.
In a document sent last month to two US regulators and the Department of Justice, Peter Zaitko, who described himself as a whistleblower, accused Twitter of lax cybersecurity.
He also accused executives at the San Francisco-based company of deliberately exaggerating the scale of the fight against fake accounts and spam.
The latest claim is likely to bolster the defense of Elon Musk, who says he backed out of buying Twitter because the company lied to him about the share of such fake accounts and spam on the social network.
On Saturday, the entrepreneur and his lawyers subpoenaed Peyter Zaitko for all documents and communications in his possession related to “the impact and consequences of fake accounts and spam on Twitter’s activities,” according to a statement seen by AFP. . .
The period from January 1, 2019 to the date of receipt of the summons is considered.
The Tesla executive also wants the testimony of Peter Zaitko, whom he called to testify on September 9 at a building near his home in New Jersey.
Peyter Zatko’s lawyer did not immediately respond to AFP’s request.
Elon Musk is also asking the former security chief to provide any documents related to measuring the number of monetized daily active users (mDAU), a key performance indicator for the group.
In addition, the billionaire wants to receive a written record of presentations that Peyter Zaitko allegedly made to management about the risks of cyberattacks and deficiencies in Twitter’s IT system.
It is also interested in any documents and communications “relating to Twitter’s attempts to hide security flaws from investors, regulators and the public,” as well as any evidence of “illegal activity” within the company.
The dispute between Twitter and Elon Musk is to be considered as part of a five-day trial, which will begin on October 17 in a specialized court in the state of Delaware.
